6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TIANHUA TECHNOLOGY, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHER LEGAL THEORIES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
7. Indemnification
You agree to indemnify, defend, and hold harmless Tianhua Technology and its affiliates, licensors, directors, officers, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of your violation of these Terms or your use of the Services.
8. Governing Law and Jurisdiction
The formation, execution, interpretation, and dispute resolution of these Terms shall be governed by the laws of the mainland of the People’s Republic of China, without regard to its conflict of law principles.
Any dispute, controversy, or claim arising out of or relating to these Terms or your use of our Services between you and Tianhua Technology shall first be attempted to be resolved through friendly negotiations. If negotiations fail, you agree to submit the dispute to the competent People’s Court where Nanjing Tianhua Technology Co., Ltd. is located for litigation. You hereby expressly agree to submit to the jurisdiction of the courts located in mainland China.
